WHAT WE DO


The Firm's real estate practice is centered around three main areas: Zoning and Land Use, Transactional Real Estate, and Leasing.  Many firms offer some of these practice areas, but Fuscaldo Law Group provides all three. This allows us to assist clients from their initial examination of a property, to zoning entitlement (if necessary), to property acquisition, to leasing (if desired), to the sale of the property, and almost anywhere in between. As a result, we are available to serve our clients throughout the lifespan of their real estate asset.

ZONING AND LAND USE


We are proud to have represented clients in zoning, land use, and entitlement matters in over one hundred Pennsylvania municipalities. With decades of experience handling development projects both in the City of Philadelphia and its surrounding suburbs we have helped clients with almost every type of project imaginable. We are able assist clients through the entire zoning and development approval process, from initial due diligence through to final approval. And in so doing we routinely represent clients before the vast array of municipal bodies and agencies, including Zoning Hearing Boards, Boards of Supervisors, Boards of Commissioners, Borough Councils, Planning Commissions, Historical Commissions, Architectural Commissions, Art Commissions, Shade Tree Committees and the like. 


TRANSACTIONAL REAL ESTATE


We have experience helping clients acquire and/or sell properties in virtually every asset class, including multi-family, single-family, commercial, retail, industrial, educational, medical, pharmaceutical, institutional, and recreational. We have engaged with clients in each part of the acquisition and disposition process, including zoning due diligence, title and survey review, negotiation of the agreement of sale, drafting of transaction documents, and taking the property through closing. Whether as part of a purchase or sale, or as part of the ordinary operation of an asset, we have assisted clients in the negotiation of many different collateral agreements, such as easements, restrictive covenants, deed restrictions, option agreements, rights of first refusal, rights of first offer, and licenses, among others.


LEASING


We have represented clients on both the landlord side and the tenant side. We have assisted clients with a wide variety of leasing matters, including headquarters leases, retail leases, restaurant leases, office leases, medical leases, gym leases, and residential leases.

REPRESENTATIVE MATTERS


Zoning and Land Use


  • Represented an international retailer in obtaining the necessary approvals to construct an approximately 1,000,000 sf distribution center.
  • Represented an international REIT during the rezoning of their property containing over 1,000,000 sf of Class A office space.
  • Represented an international REIT in the redevelopment of multiple office properties.
  • Represented a national industrial developer in obtaining the zoning approvals for 330,000 sf distribution center.
  • Represented a university in obtaining the zoning approvals required to expand its world renowned veterinary hospital.
  • Represented a university in obtaining zoning approvals to permit the construction of its school of music.
  • Represented a national auto parts retailer in acquiring the zoning approvals to construct multiple sites.
  • Represented an international retailer in obtaining various approvals for its headquarters campus.
  • Represented a major residential developer in obtaining subdivision and land development approval for the construction of a 200+ lot single family home residential community.
  • Represented a national fast food restaurant company in obtaining zoning and land use approvals to construct multiple sites.
  • Represented a national bank in obtaining zoning and land use approvals necessary to construct a retail banking facility.
  • Represented a museum in obtaining zoning approval necessary for the construction of an auxiliary storage facility.
  • Represented a museum in obtaining zoning approvals required for the erection of a rooftop observation deck.
  • Represented multiple national cellular telecommunication providers in obtaining zoning and land use approvals for the construction of dozens of wireless telecommunications facilities (new towers , co-locations and rooftop antennae) in the city of Philadelphia and the surrounding suburbs.
  • Represented a national scrap metal company in performing zoning due diligence for multiple sites.
  • Represented a national retailer in performing zoning due diligence for multiple sites.
  • Represented Pennsylvania's first private school for gifted students in acquiring the zoning approvals necessary to open.
  • Represented a local company in obtaining zoning approvals for a fitness facility.


Transactional Real Estate


  • Represented a health care system in the acquisition of property to construct a cancer treatment center.
  • Represented a client in the sale of two ski resorts.
  • Represented a REIT in the sale of an urban portfolio of office and mixed use buildings
  • Represented a local company in the acquisition of a larger manufacturing and corporate headquarters facility. Conducted the necessary zoning and permitting due diligence to ensure that the site could be utilized as required by the client.

  • Represented tenant client in negotiation of an approximately 40,000 sf headquarters office lease.
  • Represented an urgent care provider in the negotiation of multiple leases within its franchise area.
  • Represented landlord REIT in negotiation of all office and retail leases relating to its urban portfolio of properties.
  • Represented a local company in the negotiation of a fitness facility lease.
  • Represented tenant client in negotiation of its initial office lease.
  • Represented developer of fitness facilities in the negotiation of its headquarters lease.
  • Represented a commercial office landlord in a lease transaction with a telecommunications provider seeking to locate a cellular telecommunications facility on the roof of the building.
